These Terms and Conditions set out the basis on which Waste Clearance Canary Wharf provides waste clearance and related services to domestic and commercial customers. By placing a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any service.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

1.1 "Company" means Waste Clearance Canary Wharf, the provider of waste collection and clearance services.

1.2 "Customer" means any individual, business, organisation or entity that books or uses the services of the Company.

1.3 "Services" means waste clearance, removal, collection, loading, transportation, and associated services carried out by the Company, including but not limited to household waste removal, office and commercial waste clearance, bulky item collection, and general rubbish removal.

1.4 "Waste" means any items, materials, rubbish or refuse that the Customer asks the Company to collect and remove, subject to applicable waste regulations.

1.5 "Booking" means any confirmed request for Services made by the Customer and accepted by the Company.

1.6 "Site" means the property, premises or location where the Services are to be carried out.

2. Service Scope and Area

2.1 The Company provides waste clearance and collection services within Canary Wharf and surrounding areas, subject to availability and operational constraints. The precise service area is determined by the Company from time to time.

2.2 The Services typically include the provision of a waste collection vehicle and a team to load and remove waste from the Customer’s Site, subject to access, parking and safety considerations.

2.3 The Company may refuse to provide Services or remove particular items where it reasonably considers that such work would be unsafe, unlawful, impractical, or outside the scope agreed in the Booking.

3. Booking Process

3.1 Bookings may be made by telephone, email or through any online or digital system offered by the Company. All Bookings are subject to these Terms and Conditions.

3.2 The Customer must provide accurate information at the time of Booking, including but not limited to the Site address, contact details, type and approximate volume or weight of waste, access restrictions, parking arrangements and any special requirements.

3.3 Any quotation given prior to the Company arriving at the Site is based on information supplied by the Customer. The Company reserves the right to adjust the price if the actual volume or type of waste, access conditions or required labour differ from those described by the Customer.

3.4 A Booking will be treated as confirmed once the Company has accepted it and, where required, the Customer has provided payment details, deposit or other confirmation requested by the Company.

3.5 The Customer must ensure that an authorised person is present at the Site at the agreed date and time to grant access, confirm the Waste to be removed, and sign any job sheets or acceptance documentation.

4. Access, Parking and Site Conditions

4.1 The Customer is responsible for ensuring safe and reasonable access to the Site and any areas where Waste is located. This includes stairs, lifts, corridors, loading bays, and external access routes.

4.2 The Customer must secure any required parking or entry permits for the Company’s vehicles. Any parking charges, tolls, congestion charges or penalties incurred as a direct result of providing the Services at the Customer’s request may be added to the final invoice.

4.3 If the Company is unable to perform the Services due to lack of access, unsafe conditions or missing permits caused by the Customer, the Company may charge a reasonable call-out fee and any wasted costs.

4.4 The Customer must inform the Company of any hazards at or near the Site, including but not limited to asbestos, sharp objects, hazardous waste, contaminated materials, structural defects, or restricted areas.

5. Waste Types and Exclusions

5.1 The Company will collect and remove general household, office and commercial waste, bulky items, furniture, appliances and similar non-hazardous materials, in line with applicable waste regulations.

5.2 The Company reserves the right to refuse to collect or handle any Waste that is classified as hazardous or requires specialist handling, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, oils, gas bottles, pressurised containers, explosives, radioactive materials, and certain electrical items not permitted within general waste streams.

5.3 The Customer is responsible for notifying the Company at the time of Booking if any Waste may fall into a restricted or hazardous category. If prohibited Waste is found at the Site, the Company may refuse to remove it, adjust the quoted price to cover additional costs, or terminate the Services.

5.4 The Company will manage Waste in accordance with UK waste regulations, including classification, segregation, and transfer to licensed facilities where required.

6. Pricing, Quotations and Payments

6.1 Pricing is typically based on a combination of volume, weight, labour time, type of Waste, access difficulty and disposal costs. Any quotation provided prior to inspection is an estimate only and may be revised once the team assesses the Waste on Site.

6.2 The Company will confirm the final price with the Customer before commencing work. By allowing the work to proceed, the Customer is deemed to have accepted the revised price.

6.3 Prices are quoted in pounds sterling and, unless otherwise stated, are exclusive of any applicable taxes, duties or government charges that may apply.

6.4 Payment is due on completion of the Services unless otherwise agreed in writing. The Company may accept payment by cash, debit card, credit card or bank transfer, subject to any conditions notified to the Customer.

6.5 For commercial Customers or larger projects, the Company may require advance payment or a deposit prior to commencing work. Any remaining balance will be payable on completion or in accordance with the agreed payment schedule.

6.6 If the Customer fails to pay any amount due on the due date, the Company reserves the right to charge interest on the overdue amount at the statutory rate and to recover any reasonable costs of debt collection.

7. Cancellations, Rescheduling and Delays

7.1 The Customer may cancel or reschedule a Booking by giving the Company reasonable notice. Specific notice periods or charges may apply and will be communicated at the time of Booking.

7.2 If the Customer cancels a Booking with less than 24 hours notice, the Company reserves the right to apply a cancellation fee to cover costs incurred, including staff time and vehicle allocation.

7.3 If the Customer is not present at the agreed time, or the Company cannot gain access to the Site, the Company may treat this as a late cancellation and charge the applicable fee.

7.4 While the Company will use reasonable efforts to attend the Site at the agreed time, arrival times are estimates and may be affected by traffic, weather, previous jobs and other factors beyond the Company’s control. The Company will not be liable for any loss or inconvenience caused by delays but will endeavour to keep the Customer informed and reschedule where necessary.

8. Customer Responsibilities

8.1 The Customer must ensure that all Waste to be collected is clearly identified and separated from items not intended for removal.

8.2 The Customer must remove or secure any personal items, documents, valuables or confidential materials prior to the Company commencing work. The Company will not be responsible for items removed in error if they were not clearly separated or identified.

8.3 The Customer warrants that they have the legal right and authority to request removal of the Waste and to grant the Company access to the Site.

8.4 The Customer agrees not to request the removal of any items that are unlawfully held, stolen, or obtained in breach of any law or third party rights.

9. Company Obligations and Service Standards

9.1 The Company will carry out the Services with reasonable care and skill, in accordance with applicable waste regulations and good industry practice.

9.2 The Company will ensure that all Waste collected is transferred to appropriately licensed facilities or managed in compliance with its legal obligations as a waste carrier.

9.3 The Company will take reasonable steps to minimise disruption and avoid unnecessary damage to the Site while carrying out the Services.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.

10.2 Subject to clause 10.1, the Company shall not be liable for any indirect, consequential or economic losses, including loss of profit, business interruption, loss of data, or loss of opportunity, arising out of or in connection with the Services.

10.3 The Company’s total liability to the Customer for any loss or damage arising from any single event or series of connected events shall be limited to the total fees paid or payable by the Customer for the specific Services in question.

10.4 The Customer must report any alleged damage to property or items as soon as reasonably practicable and, in any event, within 48 hours of the completion of the Services, providing reasonable evidence and details. The Company may not be able to consider claims made outside this time frame.

10.5 The Company shall not be liable for pre-existing damage, wear and tear, or defects, or for damage arising from inadequate or unsafe structures, fixtures, or access routes at the Site.

11. Compliance with Waste Regulations

11.1 The Company operates as a waste carrier in accordance with applicable UK waste legislation and environmental regulations. All Waste collected will be handled, transported and disposed of in compliance with these requirements.

11.2 Where required by law, the Company will complete appropriate documentation, such as waste transfer notes, to demonstrate lawful transfer and handling of Waste.

11.3 The Customer agrees not to request the Company to undertake any activity that would cause a breach of environmental or waste regulations. If the Company reasonably believes that the Services requested would result in non-compliance, it may refuse or suspend the Services without liability.

12. Data Protection and Privacy

12.1 The Company may collect and process personal data relating to the Customer for the purposes of managing Bookings, providing Services, processing payments, and complying with legal obligations.

12.2 The Company will handle personal data in accordance with applicable data protection laws in the United Kingdom. Information may be shared with third parties where necessary to deliver the Services, process payments or comply with regulatory requirements.

13. Force Majeure

13.1 The Company shall not be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform, any of its obligations where such delay or failure results from events, circumstances or causes beyond its reasonable control. Such events may include, without limitation, extreme weather, natural disasters, strikes, lock-outs, transport disruption, accidents, fire, floods, or legal restrictions.

13.2 In such circumstances, the Company will endeavour to notify the Customer as soon as reasonably practicable and will seek to reschedule or resume Services when it is reasonably able to do so.

14. Termination

14.1 The Company may terminate or suspend the provision of Services immediately if the Customer is in material breach of these Terms and Conditions, including non-payment of fees or providing misleading information about the Waste or Site.

14.2 Upon termination, any amounts owed by the Customer to the Company shall become immediately due and payable.

15. Variation of Terms

15.1 The Company reserves the right to amend or update these Terms and Conditions from time to time. Any changes will apply to future Bookings and Services once published or communicated to the Customer.

15.2 The version of the Terms and Conditions in force at the time of the Booking will apply to that Booking, unless otherwise agreed in writing.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

17. General Provisions

17.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal or unenforceable, that provision shall be deemed deleted, but this shall not affect the validity and enforceability of the remaining provisions.

17.2 No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

17.3 These Terms and Conditions constitute the entire agreement between the Customer and the Company in relation to the Services and supersede any prior discussions, representations or agreements.

17.4 The Customer may not assign or transfer any of its rights or obligations under these Terms and Conditions without the prior written consent of the Company. The Company may assign or subcontract its rights and obligations where reasonably necessary to deliver the Services.
